These terms and conditions of use ("Terms") govern your use of www.myhadiya.com ("Website") and the services offered on or through the Website and MyHadiya Mobile Application. Please read these terms and conditions carefully before placing an order as by accessing or using the Website or the mobile application, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Website or the Mobile Application.

DEFINED WORDS: In these terms and conditions a capitalised word has a particular meaning. Any reference in these Terms to “we”, “us” or “our” is a reference to My Hadiya Limited and any reference to “you” or “your” is a reference to any user of the Website and, where relevant, the recipient of any Product or Service from the Website.

How we will contact you

Telephone

We may contact you by calling you on the phone number provided at the point of ordering or creating an account. By providing your phone number you agree to be contacted by phone. If you would like not to be contacted by phone you can change your preference in your account settings or you can send an email to help@MyHadiya.com.

Where we refer to “writing” or “written” also includes email. We will use the email address provided to communicate with you on the acceptance, progress and shipment of your order. We may also email you with relevant marketing material from time to time. If you would like to opt out of receiving marketing emails please amend your preferences in your account settings or send an email to help@MyHadiya.com. Please note by placing an order with us you agree to receiving essential emails relating to your purchase and product which may contain some promotional content.

Your Status

You must be over 18 to use www.myhadiya.com and the MyHadiya mobile application and by using the website and the mobile application you confirm that you are capable of entering into legally binding contract. If you are using www.myhadiya.com for an organization please make sure you have the authority to do so. 

2. PRIVACY AND COOKIE POLICY

Your use of the Website is also governed by our Privacy Policy, which can be found below. Please review the Privacy Policy to understand how we collect, use, and disclose your information.

3. REGISTRATION AND ACCOUNT

To access certain features of the Website, you may be required to create an account. You agree to provide accurate and current information during the registration process and to update such information to keep it accurate and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. THE CONTRACT BETWEEN YOU AND US FOR PURCHASING PRODUCTS

When placing and order for any Products through our Website or our Mobile Application you will be entering a legally binding contract with us.
We will send you an acknowledgement of the order by email which is just to say we have received your order. However this not an acceptance of the order. When we send you a despatch email this means that we have posted your order and your order has been accepted by us. If we suspect that you have placed the order unlawfully we may stop the delivery of your order even after sending a despatch confirmation.
Only products which have been listed in the despatch note we are legally obliged to supply with. Any product which may be part of the multiple items order which was not listed on the despatch note we will have no legal obligation to supply.
Prices charged for products include Vat and other taxes (where applicable). Please note we reserve the right to amend any prices shown incorrectly as a result of input error or technical errors. In this instance we will inform you of the correct price. If the new price is higher than the original purchase price we will bill you for the additional amount accordingly, if the new price is less than the original price paid we will refund you the difference.

5. CANCELLATION AND REFUND POLICY

 you have the right to cancel your order within 14 days. If you would like to cancel your order please email us at help@MyHadiya.com or write to My Hadiya Limited 115-117 Golden Hillock Road, Small Heath, Birmingham, West Midlands, United Kingdom, B10 0DP.
You must provide a copy of the despatch email in order for us to process the cancellation request. We cannot process your cancellation request if you do not include the despatch note.
If you cancel your order within 14 days we will refund you the cost of the product and the associated cost of the delivery. If the item was part of an order we will work out of the cost of the delivery. If the whole order is cancelled we will refund total cost of delivery. We will not refund any cost incurred by you in returning the item(s) to us unless there was an error in processing your order.
We will not be able to refund cost of any personalised products and any perishable goods such as flowers unless the products are defective.
If you are returning a faulty product please refer to the warranty information. Please bear in mind that it may be quicker to get a replacement by contacting the manufacturer. We will refund the cost of the product and the delivery cost when you return a defective product. 
Experience gift which has been activated and gift cards and vouchers are also excluded from our refund policy.

6. HOW TO PLACE AN ORDER WITH MYHADIYA

you will have to create an account with MyHadiya before placing an order. For this we require you to give your real name and a valid email address. Once the account is created you can add items to your shopping cart and finally submit the order. This will take you to payment screen and request you to make the payment. By making the payment you confirm placing an order with MyHadiya and accept our terms and conditions.

How you will know we have accepted your order

We will send you a confirmation email of receiving your order followed by a despatch email. Receiving the dispatch note is a confirmation that we have accepted your order.
Why sometimes we cannot accept your order
We may not be able to accept your order for various reasons, this includes the following but not limiting to:

  • We suspect you have placed the order unlawfully
  • The product you ordered is out of stock
  • We cannot meet the delivery deadline specified by you
  • The manufacturer has identified a fault with the product
  • The files used for personalised items is corrupt or cannot be retrieved
  • The material used for personalised items does not meet our rules

Your order number

With the confirmation of your order you will receive an order number which you must quote when you are contacting us regarding your order.
Ordering multiple products
We will always try to send multiple products together to reduce delivery cost for you and to reduce the carbon foot print of your order. However there may be times when we have to send your order separately and this may incur a separate delivery charge.

7. OUR PRODUCTS

The picture shown on the Website and the Mobile application is for illustration purposes only. We have taken care to show the product as accurately as possible however we cannot guarantee the product will be exactly as shown on the picture.

The packaging shown may vary when delivered.
Personalised Products 
In relation to personalised product please note:

  • There are no errors in text (please check before submitting)
  • Images are not distorted
  • That you have the permission to use the image or video you are uploading
  • We reserve the right store, use and amend any material you use for your personalised products
  • We reserve the right to not include any material which is “inappropriate”. A list of inappropriate material for personalised items can be found  << here >>

Substitute gifts or flowers

We may in exceptional circumstances send substitute flowers and gift due to not being able to provide the exact product purchased.

Halal

We have taken care to make sure all edible products are halal, however we cannot guarantee all products to be halal.

8. DISPATCH, DELIVERY AND PROVIDING THE PRODUCTS

Dispatch date does not mean delivery date. We make every effort to deliver accordingly to your requested date or the next day however we cannot guarantee this. We work with a range of delivery partners and their delivery time frames can be found <<here>>

Cost of delivery will be calculated when you submit the order. We may show you various options for delivery from which you will need to choose one.

We are not responsible for late delivery of your order which is beyond our control and our courier will leave the order in a safe place if the recipient is not at home. The courier will leave instructions for the recipient on how to retrieve their parcel. If it is not possible to leave the item in a safe place or with a neighbour the courier will leave instructions on how to re-arrange delivery.
